Please read and agree to our terms:

1. We have selected ccbill as our 3rd party processor. CCBill tracks the visitors you send to our sites and tracks all signups made by visitors you send to our site. CCBill sends out checks weekly once you sales have exceeded $25 . You will be paid 60% of the net sales amount after CCBill's processing fee (15%) has been deducted on all sales you send to our site and all recurring sales for as long as a members stays with our site. Chargebacks and returned checks will be passed on to the affiliates.

2. We reserve the rights to cancel any account that has an unusually high number of chargebacks and refunds.

3. If you send hits from any site containing CHILD PORN your account will be deleted and all monies will be forfeited. This rule is simple...just DO NOT DO IT! Also, any hits from websites containing obscene material, including without limitation any material depicting bestiality, rape or torture will be terminated.

4. No traffic from sites that contain material which constitutes an infringement, misappropriation or violation of any person’s intellectual property rights such as copyrights, trademark rights, rights of publicity, patent rights, personal property rights, privacy rights or other rights.

5. We will not be held liable for any loss due to server downtime, net congestions, and any other similiar problems.

6. NO spamming of ANY kind is allowed to our site..including IRC. You further acknowledge and agree that we have the right to immediately, and without notice, terminate your participation in the program if we, in our sole and exclusive judgement, conclude that you have engaged in the use of any form of mass unsolicited electronic mail solicitations, news group postings, password selling or trading, warez, IRC posting or any other form of “spamming”. NOTE: WE HAVE ZERO TOLERANCE FOR SPAMMING. IF YOU SPAM, YOUR PARTICIPATION IN THE PROGRAM WILL BE TERMINATED, YOU WILL BE BARRED FROM FUTURE PARTICIPATION IN THE PROGRAM AND ALL FUNDS OTHERWISE DUE TO YOU WILL BE FORFEITED.

7. We reserve the right to cancel the program at any time.

8. In order to enroll and participate in the Program, you must be over the age of eighteen (18) years, or over the age of majority if you reside and/or conduct business in states, provinces or countries where the age of majority is greater than eighteen (18) years. You may not participate in the Program in any way if you are not of the age of majority in the state, province or country where you reside and/or conduct business

9. We will not accept accounts including, but not necessarily limited to webmasters from: Albania, Armenia, Azerbaijan, Belarus, Brazil, Bulgaria, China, Cost Rica, Croatia, Czech Republic, Estonia, Georgia, Hungary, India, Indonesia, Israel, Japan, Jordan, Kaliningrad, Kazakhstan, Korea, Kyrgyzstan, Latvia, Lithuania, Malaysia, Moldova, Pakistan, Philippines, Romania, Russia, Singapore, Slovakia, Slovenia, Syria, Taiwan, Tajikistan, Thailand, Turkey, Turkmenistan, Ukraine, United Arab Emirates, Uzbekistan and Yugoslavia

10. Modification. We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion. Notice of any change by e-mail, to your address on our records, or the posting on our site of a change notice of a new agreement, is considered sufficient notice for notifying you of a modification to the terms and conditions of this Agreement. Modifications may include, but are not limited to, changes in the scope of available commission fees, commission schedules, payment procedures, and Affiliate Program rules. All such modifications shall take effect 48 hours after we serve notice as provided above, unless we indicate otherwise. If any modification is unacceptable to you, your only recourse is to terminate this Agreement. Your continued participation in the Affiliate Program, following our posting of a change notice or new agreement on our site, will constitute binding acceptance of the change.

11. Representations and Warranties. You hereby represent and warrant to us that this Agreement has been duly and validly executed and delivered by you and constitutes your legal, valid and binding obligation, enforceable against you in accordance with its terms; and that the execution, delivery and performance by you of this Agreement are within your legal capacity and power; have been duly authorized by all requisite action on your part; require the approval or consent of no other persons; and neither violate nor constitute a default under the (i) provision of any law, rule, regulation, order, judgment or decree to which you are subject or which is binding upon you, or (ii) the terms of any other agreement, document or instrument applicable to you or binding upon you. Should any law enforcement agency, internet service provider or other person or entity provide us with notice that you have engaged in transmission of unsolicited e-mails or have otherwise engaged in unlawful conduct or conduct in violation of said service provider's terms of service, we reserve the right to cooperate in any investigation relating to your activities including disclosure of your account information in connection therewith.

12. Indemnification. You hereby agree to indemnify, defend and hold harmless Hungmen Cash, its shareholders, officers, directors, employees, agents, affiliates, successors and assigns, from and against any and all claims, losses, liabilities, damages or expense (including attorneys' fees and costs) of any nature whatsoever incurred or suffered by us (collectively the "losses"), insofar as such losses (or actions in respect thereof) arise out of or are based on (a) any claim or threatened claim that our use of your trademark(s) infringes on the rights of any third party; (b) the breach of any promise, covenant, representation or warranty made by you herein; or (c) or any claim related to your site.

13. All Hungmen Cash program benefits materials, including, without limitation, all advertising banners, photographic materials, and any other form of intellectual property provided to you by Hungmen Cash as part of this program shall remain the property of Hungmen Cash and may not be copied or reproduced, altered, modified or changed, broadcast, distributed, transmitted or disseminated, sold or offered for sale in any manner, at any time anywhere in the world except as expressly authorized by us in writing.

14. Miscellaneous. Terminated accounts cannot later apply to the Program without our express written consent. This Agreement will be governed by the laws of the United States and the State of Florida, without reference to rules governing choice of laws. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
15. You must be the one who owns or is otherwise is entitled to contract on behalf of the entity which owns the rights to your website.

16. You must be a person over the age of eighteen (18) years, or over the age of twenty one (21) in those states where 21 is the age of majority.

17. Acceptance And Execution Of This Agreement. By CLICKING ON THE “I agree to the conditions outlined in the terms of service agreement” BUTTON on the signup form, and by supplying Hungmen Cash with all the required information to sign you up to the Hungmen Cash program, you are acknowledging that you agree to all of the terms, conditions, promises, warranties, duties and obligations set forth in the above agreement.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND COMPANY. BY SIGNING UP FOR THIS AFFILIATE PROGRAM YOU ARE AFFIRMATIVELY STATING THAT YOU HAVE READ AND UNDERSTAND THE TERMS SET FORTH HEREIN AND ARE AFFIRMATIVELY INDICATING YOUR ACCEPTANCE OF THIS AFFILIATE PROGRAM AGREEMENT AND YOU AGREE TO BE BOUND BY THE TERMS THEREOF.
